EB-1A vs EB-2 NIW: Extraordinary Ability or National Interest?
Compare the EB-1A green card and EB-2 National Interest Waiver — self-petition, no PERM, different legal tests (Kazarian vs Dhanasar), and when each path fits.
EB-1A and EB-2 NIW are both immigrant (green card) paths that allow self-petition on Form I-140 and do not require PERM. They ask different legal questions: are you at the top of your field, or is your proposed endeavor in the national interest?

When EB-1A is the stronger fit
EB-1A fits when the record shows sustained national or international acclaim and placement among the small percentage at the top of the field. Most petitioners use three of ten criteria, then still face a final merits determination. A one-time major internationally recognized award is an alternate path.

When EB-2 NIW is the stronger fit
NIW fits when you qualify for EB-2 (advanced degree or exceptional ability) and can show, under Matter of Dhanasar, that the proposed endeavor has substantial merit and national importance, that you are well positioned to advance it, and that waiving the job offer and labor certification on balance benefits the United States.
The endeavor’s national importance can succeed even when you are not arguing “top of the field” in the EB-1A sense. Researchers, clinicians, engineers, and founders often use this route. Read the EB-2 NIW overview.
