Published Material About the Alien

Press and trade coverage of you and your work

Official Definition

Published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought;

— 8 CFR § 204.5(h)(3)(iii)

What Adjudicators Look For

The material must be about the beneficiary (not merely quote them in passing) and must relate to their work in the field for which EB-1A classification is sought. Eligible venues include professional publications, major trade publications, or other major media. Officers assess whether the outlet has significant circulation or readership, targeted audience, and reputation in the field.

Authored articles by the beneficiary satisfy a different prong—scholarly articles at (h)(3)(vi)—not this one.

Compared to O-1A: 8 CFR § 214.2(o)(3)(iii)(B)(3) is closely aligned. For EB-1A, depth, major status of the publication, and focus on the beneficiary’s contributions matter heavily for both Step 1 and Step 2 (sustained acclaim).

      Common RFE Triggers

      Common RFE Triggers

      • No proof the publication is professional, major trade, or major media (missing circulation, audience, or reputation evidence).
      • Submitting the beneficiary’s own articles under this prong instead of (h)(3)(vi).
      • Non-substantive pieces (listicles, reprinted PR) framed as major profiles.
      • Foreign media without translation or without explanation of national reach.
      • Stale coverage with no connection to current field of endeavor claimed.

      Tips

      Pro Tips

      • Create a two-page media kit per outlet: audience, editorial board, awards, and comparable titles in the same market.
      • Prefer primary copies: scans of print pages, broadcast transcripts, or official archives.
      • Highlight bylines and dates; redact only what is necessary for privacy.
      • Cross-link coverage to objective markers of impact (sales, adoption, citations) for Step 2.

      Relevant Document Types

Press articles, interview transcripts, broadcast summaries, trade journal PDFs, and expert letters that contextualize outlet stature (secondary to objective outlet proof). In Visa Engine, Press Article is the primary mapping for this criterion.
